Fixed Rate Contract

Background on The Mack Services Group
This is your agreement for natural gas supplied by The Mack Services Group (MACK). Please keep a copy for your records. Mack Services Group is licensed by the Pennsylvania Public Utility Commission (PAPUC) to offer and supply natural gas within the PECO service territory. Our license number is A-125017. MACK supplies the natural gas to PECO Energy based on how much you consume. PECO Energy (PECO) will then deliver the natural gas to you. MACK sets the prices and charges that you pay. The PAPUC regulates natural gas distribution services provided by PECO. MACK's charges for natural gas will appear on PECO's bill in a separate section.
Definitions
Natural Gas Supply Charges - Charges for basic gas supply service sold in cubic feet. Commodity prices and charges are set by the natural gas supplier you have chosen.
Distribution Charges - Charges for the delivery of natural gas from the point of receipt into the natural gas distribution company's system for gas customers. The Public Utility Commission regulates distribution prices and services.
Basic Charges
MACK agrees to supply natural gas for my service address listed on the reverse side of this letter. I agree to purchase the requirements of this service address from MACK at the price indicated on the reverse side of this letter, and term listed beginning on the earliest start date permitted. I authorize MACK to contact the utility and initiate this service on my behalf. I understand that MACK may conduct a credit check prior to final approval of my service with MACK.
Service Provisions
  1. Term: Service will begin on your next scheduled meter read date after your enrollment has been accepted by PECO and continue for the term as listed on the reverse side of this letter. ("Initial Term”) If you have a fixed duration contract approaching the expiration date, or whenever we propose to change our terms of service, you will receive two separate written notifications. The first approximately 60 to 75 days in advance and the second 45 days in advance of either the expiration date or the effective date of the proposed changes. These notifications will explain your options going forward. . You understand that with fixed rate offers that the variable price PECO charges could be higher or lower at any given time than the fixed rate offer offered by The Mack Services Group.
  2. Cancellation/ Relocation Provision for Commercial Rate GC Customers: All Commercial customers Rate Code GC may cancel natural gas service with us at any time without penalty. Cancellation becomes effective upon the processing of your cancellation request by PECO. PECO Energy requires an 11 day notice prior to your next scheduled meter read date to transfer your account to a new supplier or back to PECO. If you move to another location within PECO service territory, this agreement is cancelled.
  3. Cancellation/Relocation Provision for Residential Rate Code GR Customers: All residential customers Rate Code GR may cancel natural gas service with us at any time without penalty. Cancellation becomes effective upon the processing of your cancellation request by PECO. PECO Energy requires an 11 day notice prior to your next scheduled meter read date to transfer your account to a new supplier or back to PECO. If you move to another location within PECO service territory, this agreement is cancelled.
  4. Billing: You will receive a single bill from PECO that will contain PECO's charges and MACK's charges. Payment will be due according to PECO's billing schedule.
  5. Right of Rescission: You may cancel this agreement within three (3) business days of your receipt of the agreement by contacting The Mack Services Group by telephone at 1-888-570-6225, by email at customerservice@mackservicesgroup.com, or by writing to Mack Services Group, 45 Branch Avenue, Berwyn PA 19312. Any cancellation after the third business day is subject to the provisions of item 3 and item 4.
  6. Dispute Procedures: Contact MACK at 888-570-6225, by mail at 45 Branch Avenue, Berwyn PA 19312 or email at customerservice@mackservicesgroup.com with questions concerning our terms of service or natural gas charges. You may call the PAPUC at 1-800-692-7380 if you are not satisfied after discussing your terms with MACK.   7. Liability: We assume no liability for the following items associated with PECO Energy: Operations and maintenance of their system, including any interruption of natural gas service, gas leaks, or explosions caused by gas leaks, termination of service or deterioration of their service. In the event of an emergency the customer should call PECO Energy at 1-800-841-4141.
  8. Limits on Warranties and Damages: You understand and agree that there are no warranties, either express or implied, associated with this offer or the natural gas sold hereunder. Mack will bear no liability to you or any third party for consequential, punitive, incidental, special or other indirect damages.
  9. Governmental Actions: In the event that changes in any laws, orders, rules, tariffs, or regulations has the effect of increasing our cost of natural gas, we will advise you of such change and notify you of the new price at which we propose to continue to serve you under your Agreement. We will advise you of such proposed new contract price in two advance notices prior to the effective date of the new price. You may then affirmatively elect the new contract price and we will continue to provide natural gas service at that price, or if you do not elect the new contract price, Mack Services Group has the option of returning your account to PECO Energy's default supply service.
  10. Assignment: MACK may assign this agreement in whole or in part, to an affiliate or third party. MACK will provide you a 30 day notice of any assignment.

  1. Term: Service will begin on your next scheduled meter read date after your enrollment has been accepted by PECO. Your first month's rate with MACK is stated on the reverse side of this letter. This rate is guaranteed for your first full billing cycle only. On the 1st day of each month your price will be established, based on such factors as the market price of natural gas using the New York Mercantile Exchange (NYMEX) as a reference plus transportation costs and other related charges. This monthly variable pricing plan will continue in force on a month to month basis until the agreement is cancelled by either party. You may obtain each month's variable price by visiting our website at www.mackgas.com, or call us at 1-888-570-6225.
  2. Variable Rate - THIS IS A VARIABLE RATE CONTRACT AND THERE IS NO LIMIT ON THE RATE THAT CAN BE CHARGED OR THE AMOUNT BY WHICH THE RATE CAN CHANGE FROM ONE BILLING MONTH TO THE NEXT. You may contact MACK at 888-570-6225 or by going to our website at www.mackgas.com to obtain the most current variable price as well as historical pricing for this rate. Historical pricing is not indicative of present or future pricing.
  3.   • If I switch to The Mack Services Group for my natural gas, will new pipelines be required to my home or business?
    • No. We are only responsible for purchasing and scheduling the delivery of natural gas over PECO Energy’s current distribution system. PECO Energy will continue to deliver natural gas to your home or business using their existing distribution system.
  • If I switch to The Mack Services Group, will I need a new meter?
    • No. The Mack Services Group will be able to use your existing meter to provide you with service.
  • Who will read my natural gas meter?
    • PECO Energy will continue to read your meter on the same schedule you are currently on.
  • Who do I call if I have a problem with my gas service or I smell gas?
    • PECO Energy. Even if you choose The Mack Services Group for your natural gas, you will still call PECO Energy for an emergency at 1-800-841-4141.
  • If I choose The Mack Services Group for my natural gas, will I receive a lower priority from PECO Energy if our power goes out or there is a problem with our natural gas service?
    • No. PECO Energy will respond in the same manner as in the past. They are required by law to maintain the same standards of reliability that were in place before deregulation. Besides, when PECO restores power or gas service to a neighborhood, all homes are restored at the same time, not each individual home in a particular area.
  • Is there any cost to sign up or to cancel my service with The Mack Services Group?
    • There are no sign up or cancellation fees for residential accounts. Commercial accounts may contain a cancellation fee. These fees will be detailed in the terms and conditions.
  • Will I get 2 bills each month?
    • No. We will include our charges on PECO’s bill each month. And you can still pay your PECO bill exactly the same way you pay today, even if you have automatic billing from your checking account.
  • Doesn’t PECO fix their rates each quarter?
    • PECO sets an estimated rate for each quarter. If market prices end up being higher than the estimate, PECO charges the shortfall in future bills. If market prices are less than the estimated price PECO has set the over collected amount will be refunded in future bills. In essence, the PECO rate is a variable rate for the year.
  • What happens after I choose the Mack Services for my natural gas service?
    • We send your enrollment request to PECO. PECO will send you a letter notifying you of your selection of the Mack Services Group as well as the estimated start date of your service. You also have 11 days from the receipt of the PECO letter to rescind your selection of supplier.
  • Does my service start immediately after I select the Mack Services Group?
    • No. PECO must receive your enrollment request at least 11 days prior to your next meter read date. If the enrollment request is sent less than 11 days prior to meter read date service will start the following month. Depending on timing of the enrollment request, it could take 40 days before service begins after selection.
