With our fleet system, each vehicle is assigned a card and each driver is assigned a unique identification number, one cannot be used without the other. Drivers enter the current odometer reading of the vehicle at the time of purchase along with the identification number.

Terms of payment shall be subject to the approval of our Credit Department.

This offer when accepted by you, and your acceptance by our Credit Manager constitutes the agreement between us.

Payment in Full 10 days from date of post mark. No partial payments accepted. If payment is not made within 10 days of billing date, card privileges can be forfeited and cards recalled. For any payment withheld for any longer period, Buyer will pay interest at the rate of 1 ½ % per month (or 18% per annum). There is a $20.00 fee for all returned checks. Non-payment, or failure of Buyer to tender payment for Services rendered within the aforementioned 10 day period constitutes a breach of this agreement, and automatically suspends any obligation of Seller to provide Services under this agreement. <span style=”text-decoration: underline;”>Failure to pay will result in client being responsible for ANY and ALL legal or collection fees associated with the collection of the debt.</span>

Price will be posted at pumping area. Check price before pumping gas. Notify office immediately if card is lost or stolen. Customer will be held responsible for any charges incurred prior to time of notification. Additional charges may be made for replacement of cards for any reason. Turn engines off before pumping gas. No smoking in pumping area. Place nozzle on pump before leaving area. Kerosene that I purchase will be used for home heating use only. The purchaser shall be responsible for all purchases made by the purchaser or any other persons using the cardlock cards issued to the purchaser, regardless of whether use by an other person is authorized or is fraudulent. The purchaser agrees that they, or anyone issued cards under their account, will not have the PIN# security access code on or near the card should it become lost, stolen or used fraudulently.

This agreement contemplates that Seller will remain in business throughout the term of this agreement. Notwithstanding any other provisions, Seller is free to discontinue its business at any time by liquidating, selling, or otherwise disposing of its business, either by sale of assets or sale of corporate stock (and a sale of over 50% of corporate stock will be treated as a sale of the business for purposes of this agreement). In the event of a sale or other similar disposition, Seller will attempt to cause the purchaser thereof to assume the obligations of this agreement, and further covenants that it will not sell or assign this agreement to a purchaser of the business unless such purchaser also assumes the obligations hereunder. In any event, Seller shall be free to discontinue and liquidate its business, in which case this agreement shall be terminated effective upon sixty (60) days’ prior notice or the effective date of the sale, whichever occurs later, except as to obligations based upon performance prior to the effective date of termination. If any provision of this agreement is deemed illegal or unenforceable, the remainder of this agreement shall not be affected thereby.

Consumer Credit Protection Disclosure: Buyer hereby authorizes Seller to verify any and all information provided on the accompanying Credit Application and to make credit inquiries through credit bureaus. The Credit Application will be processed as quickly as possible. Periodic credit inquiries can be made, as deemed necessary by Seller. Upon written request, additional information as to the nature and scope of the inquiry will be provided to Buyer. The cost of credit is included in the price for goods and services.

Equal Credit Opportunity Disclosure: The Federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant’s income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.

The Federal Agency requires us to disclose to you that you need not disclose income from alimony, child support or separate maintenance payment if you choose not to do so. Having made this disclosure to you, we are permitted to inquire if any of the income shown on your application is derived from such a source and to consider the likelihood of consistent payment as we do with any income on which you are relying to qualify for the credit for which you are applying.
